How is the attorney's contingency share calculated?+
The calculator applies the agreed percentage to the recovery amount, either before or after deducting case costs depending on which method your fee agreement specifies. Always check your contract for whether costs are deducted before or after the percentage split.
What's the difference between fees deducted before or after costs?+
If costs come off first, the attorney's percentage applies to a smaller net amount, giving the client more money. If the percentage applies to the gross recovery first, the attorney's share is larger and the client absorbs relatively more of the costs.
Do contingency fee percentages vary by case type?+
Yes, typical ranges run from around 25% to 40%, and some jurisdictions cap contingency fees in specific case types such as medical malpractice. This is general information, not legal advice — check your jurisdiction's rules and your signed agreement.
What happens if the case settles for less than expected?+
The fee is still calculated as the same percentage of whatever the actual recovery is, so a smaller settlement produces a proportionally smaller fee. There is no fee at all if there is no recovery, which is the defining feature of a contingency arrangement.
Can I use this calculator for tiered contingency fee structures?+
This calculator applies a single flat percentage; if your agreement uses tiers (for example, a higher percentage if the case goes to trial), you'll need to run the calculation separately for each tier's applicable amount.
